About Measure 37

Measure 37, passed in 2004, requires state and local governments to either waive land use regulations or compensate landowners when a regulation reduces a property’s fair market value.

Why this Viewer?

The Land Use Explorer and the Measure 37 Viewer were developed to help inform decision-making related to current and proposed land uses, as well as changes in land use policy. Changes in land use can impact, both positively and negatively, the amount of prime soils, productive agriculture and forestlands, wildfire management and suppression costs, available conservation opportunities, and available ground water. With the Measure 37 Viewer, you can get a sense of these impacts by viewing claims occurring in these places.

Urban Growth Boundaries

Focusing development within Urban Growth Boundaries has been the primary tool land use laws have to assure that Oregon’s farmlands, forests, estuaries and other important lands are protected.

Soils

To make protecting the best soils a priority, the Oregon land use laws rely on the designations of "high value soils" of the Natural Resources Conservation Service (NRCS), represented by soils in Class 1 and Class 2.

Forest Land

While forest lands vary in their productivity as markedly as farmlands, statewide planning goals focus on maintaining productive forests. The Oregon Natural Heritage Information Center mapped forestlands statewide.

Fire Risk

The Oregon Department of Forestry developed a statewide assessment which identifies "communities at risk" from wildfire from low to high.

Conservation Opportunities

The Oregon Department of Fish and Wildlife (ODFW) recently completed a statewide conservation strategy. This strategy identifies the most important places for wildlife and habitat conservation to occur.

Ground Water Restrictions

The Water Resources Department has mapped "critical ground water areas" and "ground water limited areas" to protect existing water users from depleted supplies.

Please note that not all Measure 37 claims are included and some claims may have been denied or withdrawn since the creation of the database, so it is best to check with the City, Metro, County and/or State for the most current information. Through the application you can search for various parcels by address, city or county.

The spatial information used in the Measure 37 Viewer was derived from a variety of sources provided on an "as is" basis. The parcel boundaries and corresponding Measure 37 data were prepared by the Institute of Portland Metropolitan Studies (IMS) at Portland State University. Our data sharing agreements with most counties do not permit us to allow the downloading of tax parcel boundaries, for this reason Oregon State University Libraries cannot offer this service. Also, users should be aware that temporal changes may have occurred since this data set was collected and that some parts of this data may no longer represent actual conditions. The data is based on Measure 37 claims that were submitted as of December 4, 2006. In most cases, the data does not represent claims that have been withdrawn or rejected. Users should not use this data without a full awareness of its limitations. Users are strongly cautioned to verify all information with the City, Metro, County and/or State before making any decisions.
